Terms and Conditions

  1. General
    1. Everesting for Second Chances (“Everesting”) is organised by HCSA Community Services and/or HCSA's partners.
    2. By registering for Everesting, you confirm that you have read, understood and agree to be bound by these Terms and Conditions (“Conditions”) and HCSA’s Data Privacy Management Policy (available at www.hcsa.org.sg/privacy-policy/, which together constitute a binding agreement between you and HCSA Community Services (“HCSA”), governing your and/or your child’s/ward’s participation in Everesting.
    3. In these Conditions, references to ‘we’, ‘us’ and ‘our’ mean HCSA, HCSA’s appointed contractors, as well as HCSA’s directors, officers, agents, employees and volunteers as the context requires.
    4. HCSA will contact the Participant through email if there are important Everesting updates. Any notices sent to the Participant’s email address registered with us will be deemed as received by the Participant.
    5. HCSA reservesthe right to cancel or postpone Everesting at any time without prior notice to the Participant. If Everesting has to be cancelled or postponed for causes beyond our control, there shall be no refund of fees paid and we shall not be liable for any other loss or inconvenience caused.
    6. Any feedback, complaints, grievances, objections or protestations shall be made in writing to HCSA at everesting@hcsa.org.sg. HCSA is not obliged to consider or respond to any feedback, complaint, grievance, objection or protestation; and our decisions on all matters are final and conclusive.
    7. HCSA reserves the right to amend these Conditions without giving prior notification or any reasons thereof. Please check www.secondchances.sg (“Official Website”) for the most current version of the Conditions.
    8. HCSA’s interpretation of these Conditions, and our decisions on all matters relating to Everesting, shall be final and conclusive.
    9. These Conditions shall be governed under Singapore laws, and you agree to submit to the exclusive jurisdiction of the Singapore courts.
  2. Registration
    1. You agree to provide true, accurate, current and complete information about the Participant in the Everesting registration form, and to maintain and promptly update your registration data to keep your information true, accurate, current and complete.
    2. If you provide any information that is untrue, inaccurate, not current or incomplete, or if we have grounds to suspect that such information is untrue, inaccurate, not current or incomplete, HCSA may suspend or terminate the Participant's registration and participation, and block or otherwise refuse to permit any and all future use by the Participant of the Official Website and HCSA’s other media platforms and channels (or any parts thereof). HCSA will not in any way be liable under, and shall not be obliged to entertain, any disputes, discrepancies or complaint arising from incomplete, untrue, not current, or inaccurate information provided by or on behalf of the Participant.
    3. HCSA reserves the right to limit and refuse registration without assigning any reasons thereof.
  3. Everesting Challenge & Indemnity
    1. HCSA reserves the right to amend the Everesting participating mechanism as we deem fit in our sole and absolute discretion without assigning any reason. In such cases, efforts will be made to inform the Participant prior to the date of the Event. HCSA will not be liable for any injury, damage, loss, expense or inconvenience caused due to such changes.
    2. Participants who are pregnant, wheelchair bound, or suffering from medical conditions are strongly advised to exercise caution and to immediately cease participation if you are feeling unwell.
    3. Participants are strongly encouraged to go for a medical examination and/ or consult their medical practitioner prior to registration and participation.
    4. Participation in Everesting is strictly at your own risk. By participating and/or allowing your child/ward to participate in Everesting, you declare that you and/or your child/ward are in good mental and physical health and do not have any health condition (including but not limited to motion sickness, heart, neck, back or leg conditions) that may be detrimental to your and/or your child/ward’s well-being in participating in Everesting, and further that neither you nor your child/ward are under the influence of any alcohol and/or medication that may influence your/their ability to participate in Everesting.
    5. To the fullest extent permitted by law:

      (i) we shall not be responsible for any damage or personal injury to you or to any participant in Everesting, and/or loss or damage to any property sustained as a result of your or their participation in Everesting, including without limitation all direct loss, indirect or consequential loss, cost and expense, or loss of profits; and

      (ii) by participating in and allowing your child/ward to participate in Everesting, you agree to indemnify HCSA, HCSA’s appointed contractors, as well as HCSA’s directors, officers, agents, employees and volunteers against all claims, losses, damages, costs or expenses which may be made against or suffered by us in respect of any injury (including fatal injury), loss or damage to property arising out of or in connection with your and/or any participant’s participation in Everesting.
    6. Participants shall at all times follow our instructions for your own safety and well-being.
    7. Further, HCSA reserves the right to refuse or terminate the participation of any person in Everesting for any reason whatsoever, including but not limited to unsafe or unruly behaviour that may result in harm or damage to that person or any other persons and/or property. In such events, there shall be no refund of fees paid.
    8. We have engaged authorised photographers and/or videographers to take photographs and/or audio-video recordings at Everesting events and activities for HCSA and HCSA’s partners’ publicity and communication purposes. By attending Everesting events and activities, you are deemed to have given consent.
    9. HCSA reserves the right to replace any winners if they are deemed disqualified for any reason.
    10. Grounds for termination and/or disqualification include, but are not limited to:
      1. Everesting activitiesrecorded on any motorised vehicles and mobility devices (e.g. motorised bicycles, e-scooters, cars, motorbikes, buses, lorries, etc.)
      2. Any forms of cheating and dishonesty
      3. Sharing or transfer of Strava account to record Everesting activities
      4. Falsified Strava activity records
      5. Any unusual Strava activitie
      6. Attempts to gain an unfair advantage on other participants
      7. Improper conduct and poor sportsmanship
      Participants may be asked to provide additional physical evidence to help verify their performance. If your performance cannot be verified, your results may be annulled.
